Section 301 tariff authority offers a procedurally constrained route to replace temporary global import tariffs after emergency powers failed.
Import-tariff authority is shifting from emergency-based measures to temporary and investigatory powers under the Trade Act of 1974. Section 122 supports a global tariff measure only for a limited period, whereas Section 301 permits tariffs or trade sanctions for unjustifiable, unreasonable, or discriminatory foreign trade practices after required public-comment and hearing procedures. Current Section 301 investigations concern forced-labour imports and alleged overproduction by trading partners. A more rule-bound tariff framework may reduce, but not eliminate, commercial uncertainty, and broad use of Section 301 for near-universal tariffs may face legal challenge.

Following are the major highlights of the working the coal ministry during the year.

Steps have been initiated to strengthen the organization of CMPDIL so as to achieve such ambitious targets.

The basis of grading and pricing of thermal coals has been switched over to Gross Calorific Value (GCV) system in place of Useful Heat Value (UHV) system w.e.f. 1st January, 2012. As a result, the coal companies have been asked to strengthen the infrastructure for crushing, sizing, preparation and sampling of coal for ensuring consistency in quality. Accordingly, coal companies have taken steps to enhance the crushing facilities and sampling facilities through deployment of additional mobile crushers and coal handling plants and sampling by procuring additional bomb calorie meters as also third party sampling at dispatch end. Fuel Supply Agreements (FSAs) have been made mandatory and CIL after resolving the pending issues with power utilities have already signed 35 FSAs out of 114 and the balance are expected to be completed shortly.
