Tds on foreign remittance

Guest

ONE OF MY CLIENT WANTS TO REMIT AMOUNT FROM INDIA TO SINGAPUR TO A PVT LTD C0.THE NATURE OF PAYAMENT IS FREIGHT PAYMENT FOR AIRSHIPMENT. LET ME KNOW PLEASE WHETHER MY CLIENT IS LIABLE TO DEDUCT TAX AT SOURCE AS PE SEC. 195.

Tax Deduction at Source for cross border freight remittances requires treaty and contract analysis before withholding. Whether a remittance for air freight to a Singapore private company attracts Tax Deduction at Source is a factual and treaty dependent question. The withholding obligation cannot be determined by plain reading alone; it requires analysis of the payment's characterization, the contract and invoice terms, source of income concepts, and the relevant DTAA provisions to decide if tax must be deducted before remittance. I think, you have to refer to DTAA and other provisions along with the terms of contract to decided the issue. Merely a plain reading is not sufficient to solve the query.
