Sir,

BSNL registered in one state receives ATD (Transfer advice)for service tax/excise/capital goods issued by BSNL of other state on the basis of this they take credit of input duty/input service credit and credit on capital goods.BSNL of other states also submit invoices alongwith ATD. What is the eligibility. Urgent.

CENVAT Credit Eligibility: BSNL Can Claim Credit Only on Invoices Complying with Rule 11 or Rule 4A Requirements. A query was raised regarding the eligibility of BSNL, registered in one state, to take credit for input duty, input service credit, and credit on capital goods based on transfer advice (ATD) and invoices submitted by BSNL of another state. The response clarified that CENVAT credit cannot be claimed on documents not prescribed under the CENVAT Credit Rules. However, if the invoices are issued under Rule 11 of the Central Excise Rules or Rule 4A of the Service Tax Rules, CENVAT credit is permissible. (AI Summary)
