TDS on Salaries

Dear Sir,

Here we are in confusion a few of the employees joined in my organization. But they are come under Taxable Salaries. But the previous employer also not deduct TDS on salary. We are also not deduct salary up to Feb,2012.  We are in confusion who is the final responsible to deduct the TDS on salary.

Please solve the above query as early as possible. If  Present Employer is responsible we have to deduct the TDS on salary for the month of March,2012.

TDS on salaries: present employer must obtain Form 16 from prior employer and deduct applicable TDS for the year. The present employer must obtain the employee's Form 16 or prior-employment salary and tax details at appointment and compute and deduct applicable TDS for the year after accounting for the earlier employer's reported salary and tax, adjusting the year to date tax position before determining additional withholding. You must collect  form16 from the employee (from previous employer of the employee), at the time of appointment. Based on that, present employer must deduct applicable TDS on salary  for the whole year,after considering the Form 16 from the previous employer.

In Nutshall, now you have to deduct tds on salary for the whole year.
