HRA and Housing Loan interest exemption

Rahul Bagaria

Please opine whether HRA and housing loan interest can be given at the same time to an employee in the same city  where his place of profession is situated

There is an employee who has taken a house on loan at 40 kms away from the office but due to his health professional commitment has taken a house on rent which is 20 kms from his place of work

He wants to claim both HRA and housing loan interest as his role and responsibility demands him to be in office early and leave late from office.

Also his health does not permit him to drive long hours.

Can we give the benefit of both HRA and loan interest under this scenerio

HRA and housing loan interest claims may conflict where employee maintains a rented home nearer the workplace. Whether HRA and housing loan interest can be claimed together hinges on which dwelling is actually occupied and the taxpayer's intention: if the owned house 40 km away is not used as the family residence and functions as an investment, simultaneous claims for loan interest and HRA for a nearer rented home are likely inconsistent; proximity, city/town status, and factual occupancy must be examined. Whether 20 KM and 40 Km are in the same city, town etc. or they are different city or town?

Buying a house 40 KM away from work place may be considered as an investmetn in real estate not intended for immediate own use or use by family.
