EXPORT with payment of IGST after furnishing LUT

megala karthik

Hi,

I have furnished /filed LUT online for 2019-2020 in the GST portal...Further, I have made a shipment on May 10th 2019 with payment of IGST and filed returns for the same on June 6th...though i got a response code as SB000 in the ICEGATE website, i still have not received IGST refund....SInce I have filed LUT, is it mandatory to export only under LUT? Will I not get the IGST refund amount, which I have paid for the Export made with payment of Tax? can somebody please clarify??

Exporters Can Claim IGST Refunds with or without LUT; Filing Timing May Affect Refund Delays. An individual inquired about the IGST refund process after exporting goods with payment of IGST despite having furnished a Letter of Undertaking (LUT) online. They questioned whether using LUT mandates exporting only under it and if it affects the IGST refund. Respondents clarified that filing LUT does not impede claiming tax refunds; exports can occur with or without LUT. The delay in receiving the refund is likely due to the timing of filing necessary returns, such as GSTR-1 and GSTR-3B. The individual was advised to contact the refund authority if delays persist, as the government processes refunds promptly. (AI Summary)

Filing of LUT for the purpose of export is not a hurdle for claiming rebate/refund of tax paid. You can export by both means. LUT is just for safeguarding Govt.revenue. It is just like Bond executed. You will get your refund soon. if it is delayed, you can remind rebate/refund sanctioning authority through email. Nothing to worry at all. Govt. is very quick in sanctioning refund claim.

Transaction was on May 10th. Due date of GSTR-3B of May month is June 20th. Refund will be available only after filing both GSTR-1 and GSTR-3B. No need to worry. Refund will be alloted.
