Sub: Clarification regarding Tenofivir 300 mg + Lamivudine 300 mg + Efavirenz 600 mg

The existing format of Price Schedule in the e-Procurement portal of RITES was designed as per the previous era of taxation, wherein Excise Duty and VAT were to be quoted by the bidders. After the implementation of GST from 1st July, 2017, Excise Duty and VAT have been subsumed in the GST.

In view of above, bidders are advised to indicate the total percentage of GST/Custom Duty in place of ED/Custom Duty.

The percentage of Sales Tax/VAT may be indicated as Zero.

The declaration in the existing price schedule that credit on inputs available under the CENVAT Credit Scheme and VAT have been taken into account while quoting the rate will be considered as the declaration against GST for the same purpose. The bidders are advised to upload a declaration in this regard alongwith other documents. In addition to above, wherever GST and Custom duty both are applicable, the bidder may upload the breakup of these duties for information.

Pharmaceutical Products GST Rate and HSN Code Discussion Highlights Changes in e-Procurement Post-GST Implementation A discussion on a forum addressed the GST rate and HSN code for certain pharmaceutical products, previously exempt under General Exemption 69 and 70. The conversation highlighted changes in the e-Procurement portal of RITES, which adapted to the GST implementation from July 1, 2017. Bidders were instructed to indicate GST percentages instead of Excise Duty and VAT, which were subsumed under GST. A declaration regarding CENVAT Credit and VAT was to be considered for GST purposes. One participant sought clarification on the GST rate, suggesting it might be 12%, and requested guidance if incorrect. (AI Summary)
