cenvat credit on service tax

ashish yadav
Dear Sir
Kindly reconfirm once again there are certain Invoice raised by the
labor contractor and security as they were provided service to our
excise unit at Tarapur the invoice dated 2/4/2015 and the payment
of service tax paid by us in the Month of Aug-2016 along with the
Interest. The same can be taken credit in our excise book.
This is because of one year period of date of invoice or date of payment ?
CENVAT Credit Eligibility: Claim Must Be Made Within One Year From Invoice Date, Not Payment Date A query was raised regarding the eligibility to claim CENVAT credit on service tax for invoices dated April 2, 2015, with payment made in August 2016. Multiple responses clarified that CENVAT credit must be claimed within one year from the invoice date, not the payment date. Since over a year had passed, the credit could not be claimed. One response noted that if the service tax was paid under reverse charge, the time limit starts from the payment date. However, if paid to the vendor, the one-year limit from the invoice date applies. (AI Summary)
