Service tax credit on retention: admissibility contested relying on circular guidance and precedent; respond with SCN particulars.
Dispute concerns the admissibility of service tax credit taken on retention amounts where a show cause notice was issued; the taxpayer relies on a departmental circular and tribunal precedent to justify the credit, and the respondent requests the SCN particulars to permit a targeted reply. (AI Summary)

We have received a show cause notice for Service Tax credit taken on retention amount. For replying the said SCN, we rely on CBEC Circular No. 122/03/201-ST dt. 30.04.2010 and Tribunal`s judgement in case of M/s. Hindustan Zinc Ltd V/S. Commissioner of Central Excise, Jaipur-II - 2010 (12) TMI 342 - CESTAT, NEW DELHI= 2011(21)STR-600 (Trib.Del).

Kindly give us latest case law, if any, in the matter?

Regards,

VINAY
