We have received a show cause notice for Service Tax credit taken on retention amount. For replying the said SCN, we rely on CBEC Circular No. 122/03/201-ST dt. 30.04.2010 and Tribunal`s judgement in case of M/s. Hindustan Zinc Ltd V/S. Commissioner of Central Excise, Jaipur-II - 2010 (12) TMI 342 - CESTAT, NEW DELHI= 2011(21)STR-600 (Trib.Del).
