Import trader can do export transanctions?

Asked by
Re-export of imported goods permitted with merchant exporter registration; drawback allowed if unused, in original packing, and permission obtained.
Re-export by a trader is allowed if the party registers as a merchant exporter by obtaining an Importer Exporter Code. Drawback eligibility requires the goods be unused, in original packing, exported within the prescribed time limit from import, and exported with prior permission from the Board or competent customs authority; documentary proof of these conditions is necessary to support drawback claims. (AI Summary)

We are traders and we import the material and sell the goods. Now we want to export the import material. Is it possible a trader to export who is importing the same material.

Please clarify if any notification is there to proceed.

Thanks,

Dear Karunakar,

Under Section 74 of the Customs Act, you can export the imported goods but within 2 years from the date of import, otherwise no drawback of duty would be allowed. The goods should not be used and should be in original packing. You would have to get the permission from Board.
