Stamp Paper validity at Indore, Madhya Pradesh

abhishek goyal

Dear Experts,

What is the validity period of stamp paper purchased at Indore, MP?
Is it possible to use stamp paper for any possible purpose now in year 2015, which was already purchased in year 2013 (about 2 years back)?

Kind Regards,
abhishek

Validity of 2013 Stamp Paper for 2015 Use Confirmed; No Expiration Under Indian Stamp Act; Ethical Concerns Noted. A query was raised regarding the validity of stamp paper purchased in Indore, Madhya Pradesh, in 2013 and its usability in 2015. An expert clarified that under the Indian Stamp Act, there is no expiration period for stamp paper usage, although refunds for unused stamp papers are limited to six months from purchase. The Supreme Court decision in Thiruvengada Pillai Vs Navaneethammal supports this interpretation. The ethical implications of using old stamp paper for current transactions were acknowledged but not legally addressed. (AI Summary)

Dear Sir,

As you mentioned there is no validity period to stamp paper, does it mean if someone want to make a gift deed to relative and he transfers the required amount of money by cheque today and for executing the documents he can utilized the stamp paper which was purchased 2 years back? Is it not unethical that money is transferred by cheque today and stamp paper was purchased for this purpose 2 years back?

Regards,

abhishek

Dear Abhishek,

Stamp paper has no limitation period or expiry date. A stamp paper can be used at any time after purchase of it, The Indian Stamp Act only fix a period to ge the refund of unused stamp papers i.e. six months from the date of purchase but it does not defines any where the time period for use of stamp paper.

Supreme court in its decision Dated : 19/02/2008, Case : Thiruvengada Pillai Vs Navaneethammal and Anr, has calrified it.

Further, we cannot comment on emotions and on ethics but we can share with the settled legal position. It's up to you that how you take this piece of advise.
