IT Exemption for Mediclaim (u/s 80 D) for parents of spouse

Guest

Hi,

I have two Mediclaim Policies as follows:

  • 1st Mediclaim Policy: Myself, My father and My Mother (Annual Premium β‚Ή 12,712/-)
  • 2nd Mediclaim Policy: My Wife, Father-in-Law and Mother-in-Law (Annual Premium β‚Ή 12,328/-)

(Note: My Father and my Father-in-Law are Senior Citizens)

u/s 80 D: Limits of tax exemption are as follows:

  • for self, spouse, dependent children + parents = Max - β‚Ή 15,000/-
  • for senior citizen parents = β‚Ή 35,000/-

I have two queries:

  1. Can I consider Mediclaim of my Father-in-Law and Mother-in-Law for tax exemption?
  2. As you can see that both policies are combined with senior citizen member, what will be exactly eligible amount for tax exemption?

Thanks.

Tax Exemptions Under Section 80D Exclude In-Laws: Clarification on Eligible Amounts for Mediclaim Policies. An individual inquired about tax exemptions under Section 80D for Mediclaim policies covering their family and in-laws. They have two policies: one for themselves and their parents, and another for their spouse and in-laws, with both fathers being senior citizens. The individual asked if they could claim tax exemptions for the in-laws' policy and sought clarification on eligible amounts. A respondent clarified that tax exemptions under Section 80D do not cover in-laws, as the term 'family' is defined as the spouse and dependent children, excluding in-laws. (AI Summary)

Whether you have got cleared in the above query. However I give my view. You are not eligible for the medical of your father-in-law and mother-in-law for tax exemption, since explanation to Section 80D(2) defines the term 'family' as spouse and dependent children.
