difference between

VINOD KUMAR

Dear Experts,

Please reply what is the difference between 'removal of bought out as such' and 'removal of inputs as such'. Is duty payable on transaction value on such removal or equal to Cenvat availed as per Rule 3(5) of CCR 2004. Can it also have service tax implications. Is Rule 6(3D)(c) of CCR 2004 applicable as trading is exempted service. Can valuation rules be applicable when bought out goods are purchased from sister units.

Please do share your valuable views.

Removal of inputs as such: whether valuation follows transaction value or equals Cenvat availed and service tax implications. Query asks whether the distinction between removal of bought out as such and removal of inputs as such affects valuation: should duty be on transaction value or capped at an amount equal to Cenvat credit availed; whether valuation rules differ for purchases from sister units; and whether service tax or trading-exemption provisions alter the treatment.
