Limit for credit taken of service tax on input service ie supplementary invoice

VManivannan PVellingiri

Dear Sir/Madam,

I am one of the service provider and having RC for repair and maintenance of pulp machinery. Pertain to this I forget to register service tax RC in a right time. But recently I got RC on or before March'2014. After that I made supplementary invoices for my service during the years 2011-12 and 2012-13 and the same were submitted to my all clients to demand service amount and tax. My clients question is, what is the time period or limit for service tax credit against input services.

Service provider can claim CENVAT credit on old invoices; new six-month limit effective from October. A service provider in the repair and maintenance of pulp machinery sought advice on the time limit for claiming service tax credit on input services via supplementary invoices for services rendered in 2011-12 and 2012-13. The response clarified that there is currently no time limit for availing CENVAT credit, allowing clients to claim credit based on paid invoices. However, it was noted that an amended law effective from October would require credit to be availed within six months from the invoice date. (AI Summary)
