Limit for credit taken of service tax on input service ie supplementary invoice

Dear Sir/Madam,

I am one of the service provider and having RC for repair and maintenance of pulp machinery. Pertain to this I forget to register service tax RC in a right time. But recently I got RC on or before March'2014. After that I made supplementary invoices for my service during the years 2011-12 and 2012-13 and the same were submitted to my all clients to demand service amount and tax. My clients question is, what is the time period or limit for service tax credit against input services.

Service tax credit: no current time bar for cenvat claims, but an amendment imposes a short post-invoice claim period. There is currently no time limit for availing cenvat credit where tax has been paid and invoices supporting the input service exist, so recipients may take credit based on those invoices; an amendment effective from October introduces a time-bound constraint requiring credit to be availed within a limited period measured from the invoice date. Hi Mr Manivannan

There is no time limit for availing of cenvat. So if you have paid the tax , based on your invoices your customer/client will be able to take the credit.

Note:- From October the amended law will be applicable, where the credit has to be availed within 6 months from the date of Invoice.
