We hv a company who is registered with excise, the company has imported the capital goods and for the same party has availed clearing and forwarding and gta service and make payment for the same.

so, pls clarify that can we avail the cenvat of service tax paid for the same

Yes, credit can be availed, as explained above.

However, in case of GTA do ensure that not only payment made to the transporter but also service tax thereon is paid by your company, and thereafter GTA credit to be availed.
