SURYAKANT MITHBAVKAR

We are manufacture of Pharmaceutical Goods fall under Chapter 84. We have renovate our office by purchasing new Modular Office Furniture.

If we have capitalise that modular office furniture in our books can we avail cenvat credit on that.

If we have shown Repairing to our office and book in Repairs account can we avail cenvat credit.

Pl. advice.

Pharma Manufacturer Queries CENVAT Credit Eligibility for Modular Furniture; Clarification Needed on Office vs. Factory Use A manufacturer of pharmaceutical goods inquired about the eligibility for CENVAT credit on newly purchased modular office furniture and office repairs. Responses highlighted that CENVAT credit is generally allowed for furniture and stationery under the Central Excise Act. However, for furniture to qualify as capital goods, it must meet specific chapter headings and be used in the manufacturing process, not just in office settings. A circular from the Tax Research Unit clarified that credit is allowed for goods used in factories, including furniture used in manufacturing-related activities, but not for those used solely in offices. Further clarification from authorities was recommended. (AI Summary)
