Dear Sir
We are taking legal services from consultant firm, we are paying him service tax on professional services provide by him. But he also gives us seperate bills for visit to attend the hearing, clerical and typing work and on these part he is charging service tax.
Have we pay service tax on it, if yes, under which provision of service tax it is payable by us.
Please clarify the same.
Thanks & regards
Kamal
Clarification Sought on Service Tax for Legal Services: Impact of Consultant's Status and Applicable Tax Mechanism A participant inquired about the applicability of service tax on separate bills issued by a consultant firm for legal services, including hearings, clerical, and typing work. A respondent sought clarification on whether the consultant firm comprised advocates and the company's status, as these factors affect tax obligations. Another response highlighted that if the consultant operates as a private limited company, a 12.36% service tax applies to all services. However, if the consultants are advocates, the reverse charge mechanism applies, affecting how the service tax is handled for advisory or representation services. (AI Summary)
