It was noted that many non-scheduled operators were not paying the required service tax. As of May 16, 2008, services involving the supply of tangible goods, like aircraft, without transferring possession and control, are taxable under Section 65(105)(zzzzj). The chartering of aircraft typically does not transfer possession or effective control, especially in wet leases where the crew is provided. Authorities are instructed to review cases in their jurisdiction and recover any due taxes, reporting their findings to the Director General of Service Tax.
