<h1>Supreme Court Appeal on Countervailing Duty for Ship-Breaking: Show Cause Notices to be Held in Call Book.</h1> The circular addresses the inclusion of show cause notices related to the levy of Countervailing Duty (CVD) on imported vessels for breaking in the 'Call-Book.' Following a Gujarat High Court judgment, which ruled that CVD cannot be levied on non-manufactured goods, the department has appealed to the Supreme Court. Pending the appeal, show cause notices for non-payment of CVD are to be kept in the call book. Importers voluntarily paying CVD and claiming CENVAT credit should not face denial of credit. Amendments to the CENVAT Credit Rules allow ship-breaking units to avail 100% credit of CVD paid, aligning with rule 6 provisions.
