<h1>New Tax Rule Simplifies Clearance for Foreign Workers in India, One-Time Certificate Valid for Up to 5 Years.</h1> The circular addresses the simplification of the tax clearance procedure for foreign employees not domiciled in India, as per section 230 of the Income-tax Act, 1961. Previously, these employees needed a clearance certificate each time they traveled abroad, which was cumbersome. The new procedure allows a one-time clearance certificate for foreign employees with a fixed service tenure in India of up to five years, provided their employer guarantees payment of any due taxes during and two years after the contract. This guarantee can also cover the employee's spouse and dependents. The revised procedure applies when the employer is an Indian or tax-assessed foreign entity with a business presence in India.
