Issues: Whether the applicants were entitled to waiver of pre-deposit and stay of recovery in respect of the duty demand and penalty arising from availment of Modvat credit.
Analysis: The demand required detailed scrutiny, and the alleged fraud at the suppliers' end made the question of invocation of the extended period under Rule 57-I debatable. At the prima facie stage, the Tribunal observed that the decisive consideration for Modvat credit was whether duty had in fact been paid to the Government exchequer, and that any payment made to the suppliers would, at best, give rise to civil consequences. Since the factual position required examination at the final stage, the amount demanded was directed to be secured by retention in the Modvat account, with recourse to a bank guarantee only for any shortfall.
Conclusion: The applicants were granted conditional stay and waiver of pre-deposit, subject to compliance with the direction to secure the demanded amount.
