A comparable could not be rejected outright merely because its financial year differed where suitable adjustment was possible. Archohm Consultants Pvt. Ltd., M/s. IBI Chematur (Engineering & Consultancy) Ltd., M/s. Semac Ltd., M/s. Orient Engineering & Commercial Co. Ltd., M/s. Killick Agencies & Marketing Ltd. and M/s. TSR Darashaw Ltd. were excluded; M/s. Ma Foi Management Consultants Ltd. was directed to be included, while the other entities proposed by the assessee were rejected. Functional comparability of IT-enabled service providers - Segmental information of IT-enabled service comparables - HELD THAT: - Entities engaged in outsourcing activities without segmental details, or in knowledge process outsourcing activities, were not comparable to the assessee's IT-enabled services. The proposed inclusion of entities whose segmental details or financial information required examination, and of an entity rejected under the service-income filter, required verification by the Transfer Pricing Officer. [Paras 16, 17] M/s. Vishal Information Technologies Ltd., M/s. Cosmic Global Ltd. and M/s. Crossdomain Solutions Pvt. Ltd. were excluded. The proposed comparables M/s. R System International Ltd., M/s. Motif India Infotech Pvt. Ltd. and M/s. Datamatics Financial Services Ltd. were remitted to the Transfer Pricing Officer for verification and fresh computation, subject to the assessee furnishing the requisite material. Correction of margins of selected comparables in the IT-enabled services and support services segments - HELD THAT: - The alleged errors in the margins of the specified comparables required factual verification and reconciliation. The assessee was required to substantiate the claimed corrections in consequential proceedings. [Paras 18] The margin corrections were remitted to the Transfer Pricing Officer for verification and consequential computation without adjudication on their merits. Risk adjustment in transfer pricing comparability - Economic adjustment for differences in the risk profile of the assessee and the comparables - HELD THAT: - The claim for risk adjustment was directed to be considered afresh in consequential proceedings, with the assessee bearing the responsibility to substantiate its claim. [Paras 19] The claim for risk adjustment was remitted to the Transfer Pricing Officer for fresh adjudication without a merits determination. Final Conclusion: The appeal was partly allowed. The specified comparables were excluded or included as directed, while the remaining matters concerning proposed comparables, margin corrections and risk adjustment were remitted for consequential examination.
