Seeking permission of this Court to withdraw the writ petition with liberty to the petitioner to pursue the assessment proceedings by furnishing its reply taking all grounds of facts and law as are available to it - HELD THAT:- The Writ Petition is dismissed as withdrawn with the liberty sought. Needless to say, the Assessing Authority would consider the grounds taken by the petitioner in its reply on the issue of search and seizure as well while passing the assessment order/order-in-original within a reasonable time. Petition dismissed. Petitioner sought permission to withdraw the writ petition 'with liberty to the petitioner to pursue the assessment proceedings by furnishing its reply taking all grounds of facts and law as are available to it.' The Writ Petition was 'dismissed as withdrawn with the aforesaid liberty.' The court directed that the Assessing Authority would consider the grounds raised by the petitioner in its reply, including the issue of 'search and seizure,' 'while passing the assessment order/order-in-original within a reasonable time.'
