Petitioner's deposit held pending final adjudication.</h1> The Bombay HC set aside the order of the CESTAT due to contradictions, remanding the matter for fresh consideration by the original authority. The ... Appellate orders- contradictory orders of Tribunal running counter to each other holding the field in the case of petitioner itself, the one impugned in the petition and another dated 22.9.2003. Held that- two contradictory orders in respect of same petitioner cannot be allowed to hold the field. Impugned order set aside and matter remanded back to authority in original for consideration afreash. The Bombay High Court set aside the order of the Customs Excise and Service Tax Appellate Tribunal due to contradictory orders, remanding the matter back to the original authority for fresh consideration. The deposit made by the petitioner will remain with the revenue until final adjudication.
