                              ITAT remands case to determine if sold land qualifies as agricultural property exempt from capital gains taxation under section 2(14)

                              ITAT Pune remanded the matter back to CIT(A)/NFAC to determine whether land sold by appellant constituted agricultural land or capital asset under section 2(14) of IT Act.                               "We find force in the arguments of Ld. counsel of the assessee that Ld. CIT(A)/NFAC has erred in not deciding the issue raised by the assessee and therefore we deem it appropriate to remand the matter back to the file of Ld. CIT(A)/NFAC to decide the issue raised before us through ground no.1- that whether the long term asset being immovable property sold by the assessee was agricultural land and not a capital asset chargeable to tax within the meaning of section 2(14) of the IT Act, afresh and as per fact and law after providing reasonable opportunity of hearing to the assessee."
