Conclusion: The deletion of the addition for alleged unaccounted purchases/excess stock was upheld in favour of the assessee.
Issue (ii): Whether expenditure on freezer boxes supplied to vendors was capital or revenue expenditure.
Analysis: The freezer boxes were supplied to vendors for preservation and sale of perishable milk products and remained with them in the ordinary course; they were seldom returned. The expenditure facilitated trading operations, reduced spoilage and sales returns, and did not create an advantage in the capital field. The enduring-benefit test was not conclusive, since an advantage facilitating efficient conduct of business while leaving fixed capital untouched is revenue in character.
Conclusion: The expenditure on freezer boxes was revenue expenditure, and deletion of the disallowance was upheld in favour of the assessee.
Issue (iii): Whether disallowance of salary paid through a consolidated bank payment to village-level collection-centre staff was sustainable.
Analysis: The consolidated payment was made to the bank for onward credit to identified employees' accounts. The employee names, payment amounts, account details, bank particulars and IFSC details were available. A consolidated salary debit through a bank is a recognised business-payment mechanism, and the evidence was not rebutted by contrary material.
Conclusion: The salary disallowance was unsustainable, and its deletion was upheld in favour of the assessee.
Final Conclusion: The deletions of all substantive additions and disallowances were sustained.
Ratio Decidendi: A survey working lacking reliability and corroboration cannot support an addition for unaccounted transactions, and expenditure that merely facilitates trading operations without creating a capital-field advantage is revenue expenditure.
