Validity of the assessee's independent status and filing of returns.Issue 1: Delay in filing appealThe appeal in ITA No. 4975/Mum/2019 for A.Y. 2014-15 was delayed by 2 days, and the assessee filed a petition for condonation of delay. The delay was condoned, and the appeal was admitted for adjudication.Issue 2: Assessment of income tax exemptionThe assessee, an educational institution under SNDT Women's University, claimed exemption under section 10(23C)(iiiad) of the Act. The Income Tax Officer treated the assessee as a BOI and denied the exemption. The CIT(A) upheld this assessment, stating that the exemption was not claimed by the assessee and that it was not entitled to exemptions under sections 11 and 12 as an independent entity.Issue 3: Classification as a Body of IndividualsThe AO treated the assessee as a BOI, separate from SNDT Women's University, rejecting the plea that the assessee was only a constituent of the university.
