                              The Applicant sought directions for the Resolution Professional (RP) to hand over certain plant and machinery owned by it, which were lying at the premises of the Corporate Debtor. The Tribunal noted that Section 14(1)(d) of the IBC prohibits the recovery of any property by an owner or lessor where such property is occupied by or in the possession of the Corporate Debtor.

                              Given the moratorium's purpose to maintain the Corporate Debtor as a going concern, the Tribunal concluded that the Applicant's action to recover its assets during the moratorium was not permissible.
