Issues: Whether a request for revalidation of an advance licence remains entertainable under para 125 of the Handbook of Procedure 1992-97 even after the licence has been endorsed as transferable, or whether para 127(v) excludes such revalidation.
Analysis: Para 125 empowers the Regional Licensing Authority to consider revalidation requests on merits and to grant one or more revalidations within the prescribed outer limit. It does not distinguish between transferable and non-transferable licences. Para 127 concerns transferability and, in sub-para (v), only stipulates the validity period of a transferred licence in the hands of the transferee, namely the balance period of validity or six months, whichever is more, and also notes that the extended six-month benefit is unavailable where revalidation has already been availed. The two provisions operate in different fields, and para 127(v) does not bar consideration of revalidation under para 125.
Conclusion: The request for revalidation could not be rejected merely because the licences had been made transferable; the rejection order was unsustainable and the matter had to be reconsidered under para 125.
