These facts amount to failure to file returns and to pay tax within the statutory period. On this basis the imposition of penalties under Sections 76 and 77, directed against late payment/non-filing, was upheld. The impugned order was modified only to the extent that the Section 78 penalty was set aside while penalties under Sections 76 and 77 were maintained. [Paras 5]Penalties under Sections 76 and 77 upheld; impugned order modified accordingly.Final Conclusion: Penalty under Section 78 (suppression with intent to evade) quashed; penalties under Sections 76 and 77 for late filing and non-payment (without interest) sustained and the impugned order modified to that extent. The Commissioner found that the delay did not amount to suppression of facts to evade tax, setting aside the penalty under Section 78. However, penalties under Sections 76 and 77 were upheld due to the appellant's failure to file returns and pay tax within the stipulated period despite depositing the tax before the notices were issued.Upon review, the Tribunal concurred with the Commissioner's findings. The Tribunal acknowledged the appellant's deposit of tax before the notices but upheld penalties under Sections 76 and 77 due to the failure to file returns and pay tax within the required timeframe. The imposition of penalty under Section 78 was set aside as the delay in filing returns and tax payment was not considered as suppression of facts to evade tax.
