Issue (i): Whether depreciation was allowable on capital assets used for scientific research after full deduction had been granted under section 35.
Analysis: The relevant clause in section 35 had been amended retrospectively with effect from 1 April 1962 by the Finance (No. 2) Act, 1980. In view of that amendment, the assessee could not claim further relief for a year subsequent to the purchase and use of the asset for scientific research once full deduction had already been given.

Issue (ii): Whether surtax payable under the Companies (Profits) Surtax Act, 1964 was deductible in computing the assessee's income.

Amounts paid on account of tax on profits are not allowable as business expenditure, and the statutory scheme of the Surtax Act, including the computation of chargeable profits and the provision dealing with distributable income, did not support the claim for deduction.
Conclusion: The issue was decided against the assessee and in favour of the Revenue.
Issue (iii): Whether interest payable under section 220(2) of the Income-tax Act, 1961 was an allowable deduction.
Analysis: Interest paid for delay in payment of tax was treated as not incurred for business purposes and not deductible in computing business profits.
Conclusion: The issue was decided against the assessee and in favour of the Revenue.
Issue (iv): Whether section 40A(5) applied to remuneration paid to directors.
Analysis: The point was covered by an earlier decision of the Court, under which the provision was held applicable in the assessee's favour.
Conclusion: The issue was decided in favour of the assessee.
Final Conclusion: The reference was answered with three issues decided against the assessee and one issue decided in its favour, leaving the Revenue substantially successful on the tax questions referred.
