Conclusion: Artefact Projects Limited and Infollion Research Services Private Limited must be excluded as comparables, in favour of the assessee.
Final Conclusion: The transfer-pricing benchmarking is to be redetermined by the Transfer Pricing Officer after exclusion of the invalid comparables and after affording the assessee an opportunity of hearing.

Functional comparability of sourcing support services - Selection of Artefact Projects Limited and Infollion Research Services Private Limited as comparables for sourcing support services - HELD THAT: - Artefact Projects Limited derived its revenue from project-management and consultancy services for infrastructure projects, including engineering and architectural services. Infollion Research Services Private Limited provided consultancy services to distinct industry sectors. Their functions were dissimilar to the assessee's sourcing support services. [Paras 18, 19, 20] The inclusion of Artefact Projects Limited and Infollion Research Services Private Limited was set aside and the matter was restored to the TPO for a fresh decision after affording hearing to the assessee. Final Conclusion: The appeal was allowed for statistical purposes. The disputed inclusions in the comparable set were set aside and the matter was restored to the TPO for fresh decision in accordance with law; the remaining grounds were left open.
