Therefore, we find no case for total waiver of pre-deposit of penalties. However, taking into account the facts and circumstances of the case, the applicant is directed to deposit ₹ 3,00,000 towards penalty within a period of six weeks. - Stay granted partly. The applicant's request for waiver of penalty of Rs. 7,00,000 was partially granted. They were directed to deposit Rs. 3,00,000 within six weeks. The remaining penalty amount was waived during the appeal process. Compliance was to be reported by 29.5.2014.
