Attachment orders - stay application pending Held that:- As Tribunal had passed an order granting interim stay on the matter till the disposal of the stay application the department is not allowed to issue an attachment notice to the banker - As the said demand draft has been deposited in the credit of the exchequer the Revenue is directed to refund the amount received from the HDFC and not to proceed with recovery measures during the pendency of the stay application forthwith. The Appellate Tribunal CESTAT, Mumbai granted interim stay on a matter related to appeal no. ST/146/2012-MUM. The Tribunal directed the Revenue to refund Rs.6,03,66,313 received from HDFC Bank Ltd. and not proceed with recovery measures during the pendency of the stay application.
