The period from March 10, 1977, to July 29, 1977, (the date on which the Assessing Officer received directions) should be excluded for the purpose of computing the limitation period. Since the final assessment order was passed on August 24, 1977, it was beyond the prescribed limitation period.The court rejected the Department's argument that the entire period from July 29, 1977, should be available to the Assessing Officer for completing the assessment.
