Issue (i): whether transmission elements specifically designed for use with motor vehicles of Section XVII were classifiable under Heading 87.08/87.14 rather than under Heading 84.83.
Analysis: Section Note 1(k) of Section XVI excludes articles of Section XVII, while Note 2(e) of Section XVII indicates that parts and accessories of Section XVII do not include, among others, articles of Heading 84.83 if they constitute integral parts of engines or motors. The classification also turned on the admitted fact that the goods were made to the specifications of automobile manufacturers and were intended for use with motor vehicles. On that basis, the goods answered the description of parts of motor vehicles rather than general machinery parts.
Conclusion: The transmission elements designed for sole use with motor vehicles were classifiable under Heading 87.08/87.14 and not under Heading 84.83.
Issue (ii): whether the classification of items with alleged non-automobile use and the gear box parts required fresh examination.
Analysis: The record showed that the classification order had proceeded on a generalised basis and had not examined individual items separately, even though some goods were stated to be used in domestic electric appliances and other non-automobile applications. In such circumstances, a blanket classification could not be sustained for all items without item-wise scrutiny and reconsideration of the specific end use.
Conclusion: Fresh classification was required for the goods cleared to non-automobile customers and for the gear box and its parts.
Final Conclusion: The impugned order was set aside and the matter was remanded for de novo consideration after item-wise examination and opportunity of hearing.
Ratio Decidendi: Goods specifically designed and made solely for use with motor vehicles of Section XVII are classifiable as motor vehicle parts under Heading 87.08/87.14, but where individual items are shown to have non-automobile applications, item-wise classification must be reconsidered afresh.
