Issue (i): Whether the goods manufactured by the assessee bore the brand name of another person so as to deny the benefit of small scale industry exemption.
Analysis: On examination of the metallic plate and product photographs, the brand name appearing on the goods was held to be "Aries" with the zodiac sign, while "SUPERGRIP" was treated as separately displayed and not part of the brand name. Para 4 of the SSI notification excludes specified goods bearing the brand name or trade name of another person, whether registered or not. Since the brand name belonged to another person, the exemption was unavailable.
Conclusion: The assessee was not entitled to SSI exemption.
Issue (ii): Whether the extended period of limitation was invocable on the facts.
Analysis: The declaration filed with the department described the brand as "Aries SUPERGRIP", whereas the actual brand found on the goods was "Aries". This misdeclaration and non-disclosure of the true brand name amounted to suppression of material facts from the department.
Conclusion: The extended period of limitation was rightly invoked.
Issue (iii): Whether full penalty was warranted.
Analysis: Although duty demand was sustained, the circumstances did not justify imposition of penalty equivalent to the duty amount. Relief on penalty was therefore restricted in the interest of justice.
Conclusion: Full penalty was not sustained and penalty was reduced to Rs. 5 lakhs.
Final Conclusion: The duty demand and invocation of the extended period were upheld, but the penalty was substantially reduced.
Ratio Decidendi: Where excisable goods bear the brand name of another person, the small scale industry exemption is unavailable, and misdeclaration of the brand name justifies invocation of the extended period of limitation.
