Legislative Competence of Rule 36(4) of CGST Rules 2017

Legislative competence: Rule 36(4) may exceed rulemaking power by restricting input tax credit based on invoice uploads. Rule 36(4) conditions availment of input tax credit for invoices not uploaded by the supplier by capping credit relative to uploaded invoices; the author contends the rule exceeds the rulemaking power because the enabling provision permits procedural rules only and does not authorize substantive restrictions on the right to claim input tax credit, rendering such a restriction beyond legislative competence.   8. Hence Rule 36(4) of CGST Rules 2017 imposing restriction on the availment of the credit of input subject to uploading of the invoices by the supplier is without Legislative Competence.
  9. Rule 36(4) being the procedural provision and hence the substantive right cannot be denied due to procedural lapses.
