Declare Tax Arrears Under Clause 89 of Service Tax Dispute Resolution Scheme 2008 by September 30 to Reduce Penalties.
Clause 89 of the Service Tax Dispute Resolution Scheme, 2008, outlined in the Finance Bill, 2008, allows individuals to declare tax arrears to a designated authority between July 1 and September 30, 2008. The payable amount is determined as follows: for tax arrears from an adjudicating authority's decision, 50% of the service tax is payable if it does not exceed twenty-five thousand rupees, and 25% for interest or penalties. For arrears from show cause or demand notices, the same rates apply. If penalties exceed the service tax amount, the service tax amount is considered as the penalty.
