New Nidhi Companies Must File Form NDH-4 Within 60 Days Post-One Year Incorporation or Face Restrictions
The Central Government can declare a public company as a Nidhi upon receiving an application in Form NDH-4 and confirming compliance with Nidhi Rules, 2014. Companies incorporated after the Nidhi (Amendment) Rules, 2019 must file Form NDH-4 within 60 days after one year of incorporation or an extended period. Non-compliance restricts companies from altering share capital or raising deposits and providing loans. If a company's Form NDH-4 application is rejected or non-compliance occurs, any deposits raised will be subject to Chapter V of the Act. These provisions do not apply to companies incorporated as Nidhi after the amendment rules.
