<h1>Debtor Can Apply for Fresh Start Discharge Under Insolvency and Bankruptcy Code, 2016 If Specific Conditions Are Met</h1> A debtor unable to pay their debts may apply for a fresh start discharge of qualifying debts under the Insolvency and Bankruptcy Code, 2016, if certain conditions are met. These include having a gross annual income not exceeding sixty thousand rupees, assets not exceeding twenty thousand rupees, and qualifying debts not exceeding thirty-five thousand rupees. The debtor must not be an undischarged bankrupt, own a dwelling unit, or have any ongoing insolvency processes. Additionally, no fresh start order should have been made in the last twelve months. Applications can be made personally or through a resolution professional to the Adjudicating Authority.
