.... 2. Simplified Procedures for Returning Cargo - Board's Prescriptions The Board has prescribed simplified procedures for expeditious handling of such returning cargo. In all such cases, the vessel shall be permitted to berth only at the same Indian port from which it departed, except in the case of transshipment. The procedures to be followed in different situations, as prescribed by the Board, are as under: (a) Cargo loaded on vessel and vessel is within Indian territorial waters and EGM or SDM not filed: (i) The Master of the vessel/Captain shall submit an undertaking stating that the vessel has not crossed the territorial waters of India. In such cases, the vessel may be permitted to berth at the Indian port without filing a Sea Arrival Manifest (SAM), where the vessel had earlier departed from an Indian port and has not called at any foreign port. (ii) The containers may be offloaded at the port terminal without filing a Bill of Entry, subject to verification of the related shipping documents. .... (i) Such consignments shall be treated as exported out of India. (ii) SAM shall be filed by the Shipping Line or the authorised representative. (iii) The procedures mentioned at sub-paras (ii) to (vi) of Para 2(b) above shall be followed in these cases. 3. Recovery of Export Incentives The EDC Section, IGST Refund Section and Drawback Section of Chennai IV (Export) Commissionerate shall initiate required recovery process or ensure manual recovery of all export incentives, including IGST, Drawback, etc., wherever already disbursed, before cancellation of LEO. (d) Where the container seal is found to be tampered or not intact: (i) The Preventive Section shall forward the seal verification report through e- Office to the AC/DC in-charge of CFS under Chennai IV (Export) Commissionerate linked to the respective port - viz. Ennore, MIDPL, and O-Yard CFS - AC/DC(Preventive) shall issue Communication to Terminal/Custodian to move such containers for 100% examination. On receipt of the file, the EDC Section shall cancel the Shipping Bill and LEO through the existing facility in ICES and issue a communication to the concerned Exporter/Customs Broker - with a copy to the AC/DC (Preventive)- and forward the file to the AC/DC (Preventive) for release of the container to 'Back to Town'. v. If the seal is found tampered or not intact, Preventive Section shall record the findings and forward the e-Office file to the concerned AC/DC (Preventive), who shall direct the Terminal/Custodian to move the container to CFS under Chennai IV (Export) Commissionerate linked to the respective port - viz. Ennore, MIDPL, and O-Yard CFS -for 100% examination by the Shed Officers of Chennai IV (Export) Commissionerate, and shall forward the e-Office file to the AC/DC, CFS.
