The respondents imported medical equipments namely Anesthesia Ventilatory Systems and filed Bills of Entry by claiming the benefit of Notification No. 21/2002-Cus., dated 1-3-2002 as amended vide S. The leaflets of overseas supplier submitted by the appellant indicates that the impugned goods essentially function as a ventilator system with an additional function of delivering anesthesia. The appellants have also relied upon the User Manual, which would show that the 'The system users a microprocessor-controlled ventilator with internal monitors, electronic PEEP, Volume Mode and optional features". 6.2 The Department wants to consider the ventilator with anesthesia apparatus as a mere anesthesia delivery system.
