....brief are as follows: (a) The appellant had obtained EPCG licences dated 6-9-1995 and 30-1-1996 for import of second hand looms on payment of concessional rate of duty of 10% in terms of notification No. 110/95-Cus. ....ehousing period can be granted only subject to the fulfilment of the conditions stipulated therein and particularly with regard to conditions of the goods as to whether they susceptible to deterioration or not and whether there is justification for delay in clearance of the warehoused. (b) On expiry of the warehousing period, the goods were deemed to have been cleared unauthorisedly from the warehouse and the duty shall be payable in terms of Section 72(1)(b) of the Customs Act.
