Counsel submitted that the appeal against the order of the Tribunal which uphold disallowance for earlier years have been filed before Hon'ble High Court and for A.Y. 2011- 12. The I.T.A.T. has passed order u/s 158A of the Act, therefore, same has not attained finality and thus penalty cannot be levied. The Ld.
