The Assessing Officer was of the opinion that banker's cheques were not covered in any of the provisions of Rule 6DD of the Income Tax Rules as they were the account payee demand drafts under Section 40A()3) of the Act. The Commissioner of Income Tax (Appeals) [CIT(A)] found that the expenses were genuine but agreed with the interpretation of the AO, which was concurred with by the Tribunal. Section 85A deals with drafts drawn by one branch of a bank on another branch of the same bank. The section says that: "85-A.
