Merely because transactions were routed through bank of respective lenders will not amount to fulfill the three conditions mentioned above. So far as the gift receipt from Shri Ram Avatar Agarwal, three conditions have not been satisfied and regarding purchases it was also observed that no copy of purchase bills was available so the order passed by the Assessing Officer was erroneous and prejudicial to the interest of Revenue. We find that the Tribunal while examining the question has held as under: "As regards gift received from Sri Ram Avatar Agarwal, we find that the Assessing Officer recorded the statement of Shri Ram Avatar Agarwal. He has stated that his annual income is about ₹ 35,000/- to ₹ 40,000/-. It is further seen that Sri Ram Avatar Agarwal does not have any children. The family consists of himself and his wife.
