....olved in this case is regarding the denial of cenvat credit on the capital goods which were installed undisputedly in the appellant's own unit within the jurisdiction of the same range office. It is undisputed that the second unit where capital goods were stored is of the appellant only and it is also admitted that entire goods manufactured and cleared by other unit is received by the appellants. In such a situation, the credit of the duty paid on the capital goods by the appellants cannot be denied by the revenue authorities. I am fortified in my view with the decision in the case of Pooja Forge Ltd. vs. CCE, Faridabad [2006 (196) ELT 18 (Tri.-Del)].
