Since the appellant company does not satisfy the provisions of Rule 74A, i.e., holding LOA for a period of five years on the date of transfer and to be operational for a minimum period of two years after the commencement of production as on the date of transfer, the BOA concluded that the order dated 23.06.2015 issued by the DC, NSEZ is just and correct.
